A panel of legal experts discussed whether President Obama's recent recess appointments for the Director of the Consumer Financial Protection Bureau and three members of the National Labor Relations Board were constiutional.
When the appointments took place, the Senate had agreed to adjourn and to convene only in pro forma sessions, but did not formally vote to recess.
The panelists were Walter Dellinger of O’Melveny & Myers, Douglas Kmiec of the Pepperdine University School of Law, David Rivkin of Baker & Hostettler and Morton Rosenberg of The Constitution Project. The moderator was Peter Wallison of AEI.
