Former Bush Administration Attorney General John Ashcroft reacted to a recent court ruling on denying detainees held at Bagram Air Base in Afghanistan the right to appear in court. In his remarks at the Heritage Foundation, Ashcroft traced the history of the legal rights of prisoners of war from WWII to the present day. The federal appeals court ruling last month sets up a possible challenge to a 2008 Supreme Court ruling that did extend the right of habeas corpus to Guantanamo detainees. More »

Ninth Circuit U.S. Court of Appeals: Hepting v. AT & T

The U.S. 9th Circuit Court of Appeals in San Francisco heard oral arguments in two cases on the government's warrantless wiretapping program. Hepting v. AT & T is a class action on behalf of a group of AT and T customers who allege that the company intercepted their phone calls and electronic mail, then disclosed the information to the NSA. More »

A&C: Congressional Briefing on the Chinese Uighur Muslims Case

Washington Post Federal Courts Reporter Del Wilber discusses the case of the Uighur detainees being held at the Guantanamo Bay Detention Center. In October, U.S. District Judge Richard Urbina ordered the release of the 17 Uighur men into the United States. The Uighurs were cleared for release as early as 2003 but fear they will be tortured if returned to China. Later, the attorneys who represent the 17 Chinese Uighur Muslims participated in a Congressional briefing. More »

A&C: Arar v. Ashcroft

Second Circuit Court of Appeals heard oral argument in Arar v. Ashcroft. The case stems from the Sept. 2002 detention of Maher Arar, a Syrian-born, Canadian citizen during a layover at the J.F.K. Airport in New York City. Arar is challenging his rendition by the U.S. government to Syria, where he alleges he was tortured and released after one year without being charged. The argument was heard in an en banc session, meaning all 12 appeals judges heard the case. More »

Mr. Starr recounted his time as Solicitor General under President George H.W. Bush.
