Digital Copyright Policy for Educators

Using C-SPAN in the Classroom in Digital Form

The increasing ability of many users, including educators, to use digital versions of C-SPAN programming has not changed our fundamental policy that encourages educators to use C-SPAN for teaching and research. Consequently, many proposed uses of digital versions of C-SPAN programs fit easily into our existing licensing practices. However, the extreme flexibility of digital technology has forced some limitations.

Use of digital forms of C-SPAN programs by educators is welcomed and encouraged when:

* An educator records C-SPAN content off-air and digitizes the content.

* The degree-granting educational institution, acting on an educator's request for a specific class use, records the content and digitizes it.

* An educator digitizes content obtained from the C-SPAN Archives on videotape.

* An educator retains digital copies indefinitely for educational use.

* The C-SPAN content is displayed from a server or other removable medium in a classroom for instruction.

* The C-SPAN content is accessed by students enrolled in a specific course through a password enabled instructional web site that does not permit copying of the C-SPAN content.

* An educator provides C-SPAN content on CD-ROM/DVD, so long as it is provided for a specific course, made available free to all students in the course, and is returned to the educator or the educational institution at the end of the course.

* An educator uses C-SPAN digital content in academic presentations for which compensation can reasonably be considered to be nominal.

* An educator uses C-SPAN digital content in a distance learning course featuring a closed delivery system. This involves class transmissions and website accessible only to the students registered in the class. This would include intranets and transmission of the class via point to point fibre.

When digital forms of C-SPAN content are used in ways that might lead to an effective loss of copyright or an inappropriate use, including commercial uses, we must have the opportunity to negotiate with the proposed users. For example, the following uses will require a written license that may or may not include the payment of a license fee:

* A distance learning course featuring an open delivery system An open system is distribution which is accessible to anyone outside of the classroom. This would include transmission of the class via public broadcasting stations, local CATV or public access stations and the internet. This would also include the transmission of the class on satellite.

* An "educational" entity (e.g., publishers, teachers, educational institutions, and governments) that provides material to students or others on different campuses by computer systems, electronic access, or other media (CD-ROM/DVD).

* Any distribution of C-SPAN content in digital form (e.g., CD-ROM, DVD, or by the Internet or other electronic means) beyond the students enrolled in an educator's for-credit course.
