The Senate Judiciary Committee convened to determine which branch of the American government, executive or legislative, has the constitutional power to declare war. Mr. Katzenbach stated that under the Constitution, Congress had the exclusive power to declare war, although this rule has been enforced only sporadically in the history of our country. He also stated that the president needs the support of Congress and the American people in preparing and fighting a war, as the Vietnam and Korean wars attest, and the Constitution requires the support of Congress. close
