The Ninth Circuit Court of Appeals heard oral argument in the case SeaRiver Maritime Inc. v. Norman Mineta. The case centers on the right of the Exxon Valdez to return to Alaska’s Prince William Sound where 11 million gallons of crude oil spilled in 1989. Two years later Congress passed the Oil Pollution Act prohibiting any tanker that has spilled 1 million gallons of oil or more from entering Prince William Sound. SeaRiver, a subsidiary of Exxon, argues the law is unconstitutional. The case reached the 9th Circuit on appeal from the U.S. District Court in Alaska. That court sided with the government and upheld the law last July. close
