The panelists gave an overview of the first half of the Supreme Court term, including the key cases that were heard. They described the continuing, substantial increase in criminal cases, with an increase of over 30% for in forma pauperis (unpaid docket) cases. The downward trend in argued cases continues, as two-case argument days have become commonplace. The Court’s choices not to hear cases are also as important as the cases they choose to hear. The key cases analyzed included reviewing school desegregation in Oklahoma City schools, overturning Florida’s death penalty determination and imposing significant review standards on state appellate courts, overruling Mississippi’s custodial interrogation laws, and ruling that trial standards of relevancy do not carry over equally for grand jury investigations. close
