The guests discussed the oral argument before the Supreme Court later in the day on the constitutionality of federal sentencing guidelines. The Court will hear two cases together (U.S. v. Booker and U.S. v. Fanfan) on whether a judge has discretion in sentencing defendants. Mr. Garre, the attorney for Senators Supporting Sentencing Guidelines, agrees with the government’s contention that the federal guidelines should be upheld; Mr. Goldstein, the attorney for the National Association of Criminal Defense Lawyers, opposes this view and says only juries should make these decisions. They responded to audience telephone calls, faxes, and electronic mail. close
