Dana Berliner discussed Institute for Justice’s new report “Opening the Floodgates: Eminent Domain Abuse in the Post Kelo World.” The previous day was the one-year anniversary of the U.S. Supreme Court decision on Kelo v. City of New London, Conn. The report claims that since that decision nearly 6,000 properties have been threatened or taken under the precedent. Ms. Berliner discussed how states and localities have used the precedent, how other states and localities attempt to pass laws limiting how eminent domain is used, how real estate developers influence those decisions, and whether property owners have any recourse. She responded to audience telephone calls and electronic mail. close
