Cases discussed: Mistretta v. U.S. states that use of the U.S. Sentencing Commission, as defined in the Sentencing Reform Act, is not unconstitutional as an improper delegation of legislative authority, or as a violation of separation of powers. (Also see Supreme Court Review, 10/08/88) Massachusetts v. Oakes involves the case of a father who took semi-nude photos of his daughter for a modeling portfolio. He was then tried under a Massachusetts law designed to prevent exploitation and sexual abuse of children. The defense argues that the statute is so broad that it could be interpreted in such a way as to prosecute parents who would take pictures of their naked infant.
