Representative Robert Smith contended that flag burning goes beyond the boundaries of the First Amendment’s right of free expression, although he said he is opposed to a constitutional amendment to protect the flag. He said what he called the “amendment frenzy” would be limited in its ability to effect change, as the founders designed the amendment process to protect Americans from actions. As evidence, he noted that while over 10,000 amendments have been proposed, only 26 have been passed. Representative Smith answered viewer questions. close
