Mr. ENSIGN. Mr. President, the Ensign amendment is going to come down to a choice: Are you on the side of the patients or are you on the side of the trial bar, personal injury attorneys. That is what it comes down to. Personal injury attorneys will be able to, on their contingency fees--the first $150,000 they will be able to collectÐ33 1/3 percent. Anything above that, we are going to cap them at collecting 25 percent.
This was from an amendment that was offered in 1995 by Senator Edward Kennedy. Twenty-one Members of the current Democratic majority who were also Members of the Senate in 1995 who voted for that amendment. Let's see how that vote comes out today. It is the right amendment. Let's be on the side of the patient instead of the side of the personal injury attorneys.
