The Senate Judiciary Committee continued its confirmation hearing for Judge David Souter to serve on the Supreme Court. Judge Souter talked about the likelihood of Roe v. Wade appearing on the Supreme Court docket preventing him from addressing specific questions about the rights and interests of the unborn vs. the rights and interests of the mother. Similarly, on the topic of capital punishment, he refrained from going beyond stating that “as a simple matter of the text, the Constitution of the United States does recognize” it. Judge Souter also expressed his great appreciation and respect for the jury trial system. close
