The Supreme Court heard oral argument in Jennings v. Rodriguez, which concerns whether detained immigrants facing deportation can be held for longer than six months without a bail hearing. The class action suit brought by the American Civil Liberties Union (ACLU) against Immigration and Customs Enforcement (ICE) included approximately 1,000 immigrants who had been detained for longer than six months, either for crossing the border illegally or because they were legal residents who committed deportable crimes. The Ninth Circuit ruled that the government must provide individualized bond hearings to assess danger to the community or flight risk when a detention exceeds six months, and every six months thereafter.
