The Supreme Court heard oral argument in Nelson v. Colorado, a case questioning Colorado’s practice of not refunding court and other fees to people whose convictions of crimes were later reversed was a violation of due process.

This case involved two defendants, Shannon Nelson and Louis Alonzo Madden, who were both convicted of sexual assault and ordered to pay court costs, fees, and restitution. Nelson paid over $700, Madden over $4000. Both convictions were later reversed.

In Colorado, a person convicted of a crime that is later exonerated is not entitled to a refund. They must file a separate civil suit to prove they were actually innocent of the underlying criminal charge by clear and convincing evidence.

On April 19, 2017, the court ruled 7-1 that Colorado’s practice was unconstitutional. close
