The Second Circuit Court of Appeals heard oral argument for Zarda v. Altitude Express. The case concerns whether sexual orientation discrimination was protected under Title VII of the Civil Rights Act. Title VII protects employees from discrimination by employers based on sex, race, color, national origin and religion. In 2010, Donald Zarda, a sky diver instructor with Altitude Express, filed a lawsuit alleging that he was fired because of his sexual orientation after he revealed to a client that he was gay. Mr. Zarda died in 2014, and his estate continued with the suit.

This was an “en banc” hearing, a case heard before all the judges of a court.

On February 26, 2018, the court ruled 10-3 that federal law does indeed protect against sexual orientation discrimination in the workplace. According to the court’s ruling sexual orientation is a subset of sex discrimination and therefore is prohibited. close
