The Supreme Court heard oral argument in Merck Sharp and Dohme Corp. v. Albrecht, concerning whether drug manufacturer companies are exempt from state-mandated warnings when the federal Food and Drug Administration rejects their proposed warning label. In this case the FDA did not approve of a warning on Merck’s osteoporosis drug, Fosamax, for increased risk of bone fractures. Patients later sued Merck under state laws, claiming the drug lacked sufficient warnings. Justice Ruth Bader Ginsburg did not participate in oral argument, as was she working from home as she recovered from cancer surgery.
