The Supreme Court heard oral argument for Kahler v. Kansas, a case challenging the constitutionality of a state statute that eliminated the insanity defense. James Kahler was convicted of killing his wife, two teen daughters, and his mother-in-law. His attorney argued that he was not in the right mental state for some time after his wife had an affair with another woman, left him, took their children, and filed for divorce. A jury found him guilty and sentenced him to death. Because Kansas does not offer an insanity defense, defendants can get the death penalty even if they have a mental disorder that prevents them from knowing what they did. Mr. Kahler’s legal team filed an appeal to the Kansas Supreme Court, which upheld the death sentence. close
