The Supreme Court heard oral argument in Axon Enterprise, Inc. v. FTC, on whether the Federal Trade Commission’s administrative proceedings violates businesses' Fifth Amendment rights to due process. The case stems from a 2018 purchase by Axon Enterprise, which produces and sells police equipment including police body cameras, of a competitor, Vievu LLC. The FTC, an independent regulatory agency of the federal government tasked with enforcing antitrust law, opened an investigation into the acquisition. Throughout the investigation, Axon and the FTC could not come to an agreement allowing the merger. The agency brought an enforcement action against the company saying the acquisition was in violation of anti-monopoly laws.

The Court later ruled unanimously that people or businesses under FTC enforcement actions may challenge the agency’s legal proceedings in federal court prior to the investigation being completed. close
