The Supreme Court heard oral argument for Frank v. Gaos, concerning how the monetary awards from class action settlements are distributed. Theodore Frank, named in this case, is an attorney and argued the case before the justices. He's challenging the fairness of the $8.5 million class action settlement that resolved allegations that a subsidiary of Google, Alphabet Inc. violated user terms with third parties. The settlement money was distributed under what are called cy pres awards, meaning, a vast majority of the funds went to attorneys and charitable organizations, not to the class members or those "injured" by the company. One of the groups that received money included the AARP. The justices will decide whether cy pres awards in class action settlements are "fair, adequate, and reasonable" as required under federal civil law.
