The Supreme Court ruled 7-1, that the Health and Human Services Department should have held a public notice and comment period prior to changing its Medicare Disproportionate Share Hospital (DSH) payment formula, which resulted in lower reimbursements for some hospitals. Justice Neil Gorsuch authored the majority opinion. Justice Stephen Breyer dissented. The court heard oral argument for Azar v. Allina Health Services back in January 2019. These payments mainly go to hospitals that treat low-income or uninsured patients. Allina Health Services, a group of non-profit hospitals, sued arguing the new formula violated federal law because the agency did not undergo a notice and comment period. Justice Brett Kavanaugh recused himself from this case because he was part of the three-judge panel who heard the case at the DC Circuit Court of Appeals and authored the opinion siding with the hospitals.
