Justice Elena Kagan wrote for the majority that "the 'immoral or scandalous" bar is substantially too broad. She added, "There are a great many immoral and scandalous ideas in the world (even more than there are swearwords), and the Lanham Act covers them all. It therefore violates the First Amendment." Joining her in the majority were Justices Clarence Thomas, Ruth Bader Ginsburg, Samuel Alito, Neil Gorsuch and Brett Kavanaugh. Justice Alito also wrote a concurring opinion. Chief Justice John Roberts, Stephen Breyer and Sonia Sotomayor each filed opinions concurring in part and dissenting in part. The court heard oral argument for Iancu v. Brunetti in April 2019.
