Albrecht Oral Argument The Supreme Court ruled unanimously that a lower federal court must reconsider a case concerning ... The Supreme Court ruled unanimously that a lower federal court must reconsider a case concerning the osteoporosis drug named Fosamax and injury claims against the manufacturer, Merck Sharp & Dohme, for thigh bone fractures and inadequate warning labels. The justices heard oral argument for Merck Sharp & Dohme Corp. v. Albrecht back in January 2019. In 2010, hundreds of people nationwide who used the drug filed personal injury lawsuits in their states against Merck Sharp & Dohme. All these suits were later consolidated and landed before the U.S. District Court for the District of New Jersey. The court ruled in favor of Merck citing that they were preempted by federal law after the FDA turned down Merck's proposal to warn patients about the risks of fractures. The case then headed to the U.S. Court of Appeals for the Third Circuit where they ruled in favor of the drug users.
