On this program, Supreme Court Review, the panel analyzed the results of the first half of the Court term. Cases discussed included the Court’s 5-4 Spallone v. U.S. decision, and the implications of Missouri v. Jenkins, which had yet to be heard. Discussion regarding religion included the Court’s upholding of a California law that permitted the state to charge sales tax on merchandise sold by churches; the Board of Education v. Mergens case, which involved a high school bible study club that sought access to public school facilities under a federal “Equal Access” statute; as well as Oregon v. Smith, a case which dealt with the legality of the use of controlled substances in Native American religious ceremonies. The panel also discussed the FW/PBS v. Dallas case involving pornography, a case concerning freedom of commercial speech; the Court’s refusal to consider an issue raised by a third party; and the Cruzan v.
