Solicitor General Starr moderated the panel discussion. Starr gave a brief review of the judicial role in separation of powers disputes. Professor Carter focused on disputes between the courts and another branch of the Federal government. He criticized the Supreme Court’s recent application of judicial review in the cases of Morrison v. Olson and Mistretta v. United States. Professor Davis contradicted the Federalist Society’s statement that judges should decide only what the law is and not what it should be. close
