Mr. Seidman and Mr. Kovacic discussed the 1990 term of the Supreme Court, and the judicial activism or lack thereof displayed by the current Supreme Court. The two law professors also discussed the nomination of U.S. District Court Judge Clarence Thomas to the Supreme Court seat vacated by Supreme Court Justice Thurgood Marshall. Mr. Seidman said the 1990 Supreme Court showed by evidence of what it chose to decide and let stand that it did not fear overriding precedents, which he said boded ill for supporters of the Warren court of the 1960's. However, he added that supporters of the Warren court had little ground to stand on when arguing against overturning precedents. close
