The Senate convenes and resumed consideration of H.R. 3010, the Labor, Health and Human Services, and Education Appropriations Bill. At 10:00 a.m. the Senate proceeded to a vote on the motion to invoke cloture on H.R. 3010 and later passed the bill.

The Senate also confirmed the nomination John Richard Smoak, of Florida, to be U.S. District Judge for the Northern District and the nomination Susan Bieke Neilson, of Michigan, to be U.S. Circuit Judge.

Several senators made remarks about the president’s withdrawal of White House Counsel Harriet Miers from consideration as a justice on the U.S. Supreme Court. close
