Constitutional lawyer Clint Bolick talked about his book, David’s Hammer: The Case for an Activist Judiciary, published by the Cato Institute. He made the argument that an activist judicial branch is essential in order to keep the executive and legislative branches from becoming too powerful and threatening individuals' constitutional rights. For example, he says the judiciary should protect school choice and property rights, so that they are not compromised by the other branches of government. He was joined in discussion by M. Edward Whelan III, and Jeffrey Rosen. Mr. Rosen is the author of The Supreme Court: The Personalities and Rivalries that Defined America. After their presentations the three men responded to audience members' question. close
