San Francisco Chronicle reporter Bob Egelko spoke by telephone about the background of the case Nordyke v. King, argued before Ninth Circuit Court of Appeals in San Francisco, California, on January 15, 2009. The Court would decide if Alameda County, California’s ban on gun shows at the annual county fair is unconstitutional. Gun show promoters Russell and Sallie Nordyke contended that the ban violates their First Amendment right of free speech and their Second Amendment right to bear arms. The Alameda County Board of Supervisors passed the ban in 1999 after eight people were injured in a shooting at the 1998 fair. The case had been before the California Supreme Court but was being revisited in light of the U.S. Supreme Court decision in District of Columbia v. Heller.
