A three-judge panel at the Eleventh Circuit Court of Appeals in Atlanta heard oral argument in Florida v. the Department of Health and Human Services. The case challenged the 2010 health care law and was brought by 26 states that had banded together in opposition to the law’s requirement that everyone have health insurance. The states' argument was that Congress had exceeded its authority and was infringing on the 10th Amendment. A lower district court judge agreed with the argument and voided the entire health care law after ruling that individual insurance mandates were unconstitutional. close
