Dukes, the views of “living” versus “original intent” constitutional interpretations, the impact of Justice Elena Kagan, and upcoming cases, including the 2010 health care law cases currently being heard in circuit courts around the country. Mr. Doyle spoke at length about Justice Kagan, including her relationship with Chief Justice Roberts, the quality of her writing, and her role in oral argument.
