Power and Constraint Jack Goldsmith argues that while it is commonly held that the terrorist attacks on September 11, 2001, resulted in the executive branch obtaining unprecedented and unaccountable power, the reality is that Congress pushed back against executive power in significant ways and placed controls on the president that most people do not realize exist. This, he says, explains why President Obama has not made a major shift away from the counter-terrorism policies of the Bush administration. Professor Goldsmith was joined in discussion by three other Harvard University professors. The panelists also responded to questions from members of the audience.
