The U.S. Supreme Court heard oral argument in Schuette v. Coalition to Defend Affirmative Action. The case challenges a 2006 Michigan voter-approved constitutional amendment prohibiting consideration of race or gender in public education admission, government contracting, and public employment. The ban was approved by 58 percent of Michigan voters in response to the 2003 Supreme Court decision in Grutter v. Bollinger that upheld the use of race as one factor of many that law schools could use to ensure educational diversity. The Sixth Circuit Court of Appeals found that the ban violates the 14th Amendment’s Equal Protection Clause.
