The first afternoon session of Privacy and Civil Liberties Oversight Board public hearing on possible changes to the National Security Agency’s (NSA) data collection programs addressed the Foreign Intelligence Surveillance Court (FISC). FISCA is the U.S. federal court that oversees intelligence community classified activities, and was established under the Foreign Intelligence Surveillance Act of 1978 (FISA). The witnesses were a former FISA court judge and two lawyers who have appeared before the court. Judge Carr suggested introducing another advocate to the process, one to protect the rights of the people. He also talked about having FISA Court decisions appealed to assure the judge made the right decision. James Baker, however, argued that adding more people to the process would risk more leaks. close
