A three-judge panel at the Tenth Circuit Court of Appeals Court in Denver heard oral argument in Kitchen v. Herbert, a case challenging the constitutionality of Utah’s same-sex marriage ban.

In 2004, Utah voters passed an amendment to the state’s constitution recognizing marriage as only between a man and woman. On December 20, 2013, a federal district judge tossed out the voter-approved ban, ruling that it violated the 14th Amendment’s guarantee of due process and equal rights protection under the Constitution.
