Executive Branch and U.S.-Taliban Prisoner Exchange Jonathan Turley talked about the legal implications behind the release of Sergeant Bowe Bergdahl in exchange for five Guantanamo Bay detainees with Taliban connections. Regarding the 30-day notice the president is required by law to give Congress before taking such an action, he stated “there’s no question” that President Obama failed to follow that statute. He said that while he voted for President Obama and agrees with many of his policies, he was concerned about the precedent being set for subsequent presidencies. Among other topics he discussed President Obama’s use of executive orders and overall record on following federal law, the separation of powers, the expansion of executive branch power over recent administrations, and President Obama’s statements on executive branch power as a senator and presidential candidate versus his actions since becoming president.
