Legal scholars testified on the merits and viability of a lawsuit against President Obama brought by Speaker John Boehner and House Republicans to ensure the president was properly and faithfully executing the laws, without abusing his executive authority, specifically in the implementation of the Affordable Care Act. Professors Jonathan Turley and Elizabeth Price Foley both supported the lawsuit, saying it could roll back a shift toward increased executive branch power and restore power to Congress. Professor Turley said that although he personally supported many of President Obama’s actions, the trend of expanding presidential power, which he said began even before President George W. Bush, had reached a “tipping point.” Simon Lazarus and Walter Dellinger spoke against going forward with legal action. Mr. Lazarus argued that Congress should pass laws to address the issue instead of suing. Mr. Dellinger’s position was that a lawsuit would give too much power to the courts. close
