The Supreme Court heard oral argument in Elonis v. United States, docket number 13-983. The case involves free speech and criminal threats in the age of the internet and social media. At issue in the conviction of Anthony Elonis, who was sentenced to 44 months in prison for making threats against his wife and a Federal Bureau of Investigation (FBI) agent on his Facebook page, was proof of the defendant’s subjective intent to threaten.
