The Supreme Court heard oral argument in Texas Department of Housing and Community Affairs v. The Inclusive Communities Project, Inc., docket number 13-1371. The case addresses low-income housing and the 1968 Fair Housing Act, which bars discrimination in home sales and rentals. The focus is on “disparate impact,” a key component of the Fair Housing Act. Under “disparate impact,” discrimination in renting or housing doesn’t have to be blatantly racially motivated to be illegal. It can be race-neutral in intent, but still adversely impact a protected class of people, making it discriminatory in practice. close
