Panelists discussed the future of civil jury trials. Although a constitutional right that had been lauded as promoting democracy, the number of civil jury trials had continually declined for decades amidst the rise in alternative methods to settle disputes and victim compensation funds. Topics included the societal benefits of each method or dispute resolution. Jeffrey Rosen moderated a discussion with alternative dispute resolution expert Kenneth Feinberg, special master of compensation funds for incidents such as the BP oil spill and the Boston Marathon bombing; plaintiff’s attorney Steve Susman; and antitrust and commercial litigator Bert Rein.
