Title: Schenck v. United States: Oliver Wendell Holmes & Learned Hand Description: In June, 1918, 7 months before the U.S. Supreme Court would hear oral arguments in Schenck v. United States, Justice Oliver Wendell Holmes struck up a conversation with New York District Court Judge Learned Hand about the freedom of speech. After that conversation, the two exchanged letters reiterating their thoughts. Retired Massachusetts Supreme Court Justice Hiller Zobel shows us those letters, which are part of the Oliver Wendell Holmes Collection at the Harvard Law Library. close
