Minutes after President Obama announced his nomination of Judge Merrick Garland to succeed the late Justice Antonin Scalia on the Supreme Court, Senate Majority Leader Mitch McConnell (R-KY) said on the floor that the Senate would “let the American people have a voice on this momentous decision” by not considering the nomination. He referenced then-Senate Judiciary Committee Chair Joe Biden’s comments on the subject in 1992. Leader McConnell said the Constitution does not require the Senate to actually take up court nominations. close
