The Supreme Court heard oral argument in Pena-Rodriguez v.Colorado, a case balancing jury secrecy against the Sixth Amendment right to an impartial jury. The plaintiff sued to have his unlawful sexual contact conviction overturned because of racially charged comments made during jury deliberations. The state trial rejected Mr. Peña-Rodriguez’s request, citing a state evidentiary rule that generally bars jurors from testifying about statements made during deliberations that might call the verdict into question.
