Professor Michael Les Benedict delivered a keynote speech commemorating the 150th anniversary of the Ex parte Milligan U.S. Supreme Court case. In 1866, the U.S. Supreme Court ruled it unconstitutional to try civilians in military courts while civilian courts were operating. The Ex parte Milligan case originated in Indiana during the Civil War, where the Lincoln administration used military commissions to put dissenting civilians on trial. The case had been cited frequently since September 11, 2001, when several military commission cases came before the Supreme Court.
