The Supreme Court heard oral argument in Expressions Hair Design v. Schneiderman, Docket Number 15-1391. The case concerns whether a New York state law that stops businesses from imposing surcharges on credit cards but allows discounts for cash is regulating prices or speech. New York businesses challenging the law assert the statute violates the First Amendment because it limits a merchant’s right to describe the extra costs imposed on credit card purchases as “surcharges.”
