The Fifth Circuit Court of Appeals heard oral argument in Moore v. Bryant, a case questioning whether the Mississippi state flag and its design are discriminatory and racist. Mississippi attorney Carlos Moore was appealing a lower court’s decision to dismiss his lawsuit against the state and its governor over the Confederate battle emblem in the upper left corner of the state flag. Mr. Moore argues that the flag is hateful government speech that has a discriminatory intent and a disparate impact on African Americans in violation of the 14th Amendment’s Equal Protection and Privileges and Immunities Clauses. The lower court judge ruled that Mr. Moore did not have standing and needed to prove that he suffered harm from the Confederate emblem on the state flag. close
