Majority Leader Mitch McConnell (R-KY) raised a point of order “that the precedent set on November 21, 2013 is a majority vote on all nominations,” referring to lowering the cloture threshold to simple majority for Supreme Court nominations. Under the Democratic “nuclear option” of 2013, the cloture threshold was majority for all nominations except Supreme Court nominees, which remained at 60 votes.

Senator Deb Fischer (R-NE), in the chair, said the precedent from 2013 did not apply to Supreme Court nominations, and Senator McConnell appealed her ruling. close
