The Supreme Court heard oral argument for Jennings v. Rodriguez, a re-argument from the previous term when there were only eight justices on the bench. This case concerns the lengthy detention of individuals who are facing deportation. Alejandro Rodriguez came to the U.S. as a lawful permanent resident. The Homeland Security Department began removal proceedings against him for two criminal convictions of drug possession and joyriding. After being detained for three years, Mr. Rodriguez appeared before the Board of Immigration Appeals (BIA) to dispute the detention. In 2007, he and others filed a class action lawsuit challenging federal detention statues. The court will determine whether these individuals have the right to appear before a judge to make their case for release.
