Zarda v. Altitude Express Oral Argument The Second Circuit Court of Appeals heard oral argument for Zarda v. Altitude Express. The case concerns whether sexual orientation discrimination was protected under Title VII of the Civil Rights Act. Title VII protects employees from discrimination by employers based on sex, race, color, national origin and religion. In 2010, Donald Zarda, a sky diver instructor with Altitude Express, filed a lawsuit alleging that he was fired because of his sexual orientation after he revealed to a client that he was gay. Mr. Zarda died in 2014, and his estate continued with the suit.

This was an “en banc” hearing, a case heard before all the judges of a court. close
