The Supreme Court heard oral argument in Weyerhaeuser Co. v. Fish and Wildlife Service, a case focusing on the dusky gopher frog and its designation as an endangered species by the U.S. Fish and Wildlife Service in 2001. The Service’s conservation plan included designating as critical habitat more than 1,500 acres in Louisiana that belonged to the Weyerhaeuser Company. The company was barred from developing the land. The Eastern District Court of Louisiana in 2013 ruled in favor of the federal government, and in 2016 the Fifth Circuit Court of Appeals affirmed the lower court’s ruling and denied a request for a rehearing.

On November 27, 2018, the Supreme Court ruled 8-0 in favor of Weyerhaeuser, vacating the lower court ruling and remanding the case back to the lower court to reconsider. close
