The Supreme Court heard oral argument in Gamble v. United States, concerning an Alabama man, Terance Gamble, who was convicted of both federal and state gun charges arising from the same traffic stop. Mr. Gamble was challenging the Constitution’s double jeopardy exception, also known as the Separate Sovereigns Doctrine. This doctrine is based on long-standing Supreme Court rulings that the federal government and Alabama are separate sovereigns, and both can prosecute him for the same crime without running afoul of the Fifth Amendment’s ban on double jeopardy.

On June 17, 2019, the Court ruled 7-2 to reaffirm the Separate Sovereigns Doctrine. close
